If you continue to use this service (the Service), you are agreeing to comply with and be bound by the following terms and conditions of use, which govern our relationship with you.

ACCORDINGLY, if you disagree with any part of these terms and conditions, please IMMEDIATELY discontinue your use of the Service.

The term 'you' refers to you as the user of the Service.

The terms 'us', 'our' or 'we' refers to Check Business Limited, whose UK company number is 09004763. Check Business is a wholly-owned subsidiary of Funding Options Ltd, a company registered in England & Wales (07739337) whose registered address is 1 Old Hall Street, Liverpool, L3 9HF.

The term 'Equifax' refers to Equifax Limited, whose UK company number is 02425920, and whose registered office is Capital House, 25 Chapel Street, London, NW1 5DS.

Our Cookie policy

  • Information and materials in the Service are based on information from third parties over which we have no control, and may contain inaccuracies or errors.
  • Content and information provided as part of the Service may not be timely or correct, and will change without notice, meaning that it is for your general information and use only.
  • To support pricing of the Service that is suitable for users, we must expressly exclude liability for any inaccuracies, service failures or errors to the fullest extent permitted by law.

Accordingly, neither we, nor Equifax, nor any third parties, provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered through the Service.

Your use of any information or materials provided through the Service is entirely at your own risk, for which we shall not be liable, and in any case our total aggregate liability shall be capped at the value of no more than the last two years of any payments received from you for the Service. Nothing in these terms shall seek to exclude or limit liability for death or personal injury.

Your usage and responsibilities

By using the Service, you agree to notify us promptly of any changes in the details you have provided to us.

You agree to keep your username and password secure and to notify us immediately if you suspect that this is no longer the case. You are responsible for any activity through the Service arising out of any failure to keep your password secure. We may disable access at our sole discretion without notice or explanation.

If at any time you wish to cease using the Service, you may contact us to request deactivation of your account. Within a reasonable time of this notification, we will remove any third-party data access you may have given us. Historical data will be maintained by us as described below.

If you have agreed to pay us for any aspect of the Service, you recognise that we may withdraw your rights to use the Service as a result of non-payment.

You agree not to use the Service in a way that harms our reputation, and you agree to comply with all applicable laws and regulations, including the Data Protection Act 1998.

You agree to indemnify and hold us, our staff, officers, group companies and partners harmless from loss, damage or claim, made by third parties and/or incurred as a result your breach of these terms.

You confirm that information submitted via the process to claim your business is complete and accurate.

You agree that information submitted via the process to claim your business may be used by Check Business in any way, including publication on the Check Business website and sharing with third parties.

We may use a Credit Reference Agency to confirm the identities of individuals. By using this service you consent to us conducting ID verification checks.

Our intellectual property

You recognise that unless otherwise stated in writing neither we nor Equifax grant you any intellectual property rights in our respective trademarks.

In addition, the Service contains material which is owned by us or by Equifax, including but not limited to source code, copy, appearance and graphics, and you recognise that unless otherwise stated in writing, we do not grant you any rights to these.

We hereby grant you a non-exclusive license to use information provided by the Service solely for the internal purposes of your business and subject to the restrictions described in these terms and conditions. You will not acquire any proprietary rights (including database rights) to any information provided via the Service, and may only make such copies of information as you reasonably require for your internal business purposes.


Our management of data

We take data protection very seriously and we are committed to taking care of your business data.

In some instances, as part of providing our services to you our systems will gather data from your accounting software as well as other third-party sources. We use the information to provide you with a range of tools and services to help you run your business. This may involve using your data to interface to third party systems; to enhance the databases we use to provide the service and to enhance other risk and fraud prevention services to others; and for monitoring of performance, statistical analysis and the identification of improvements to the Service.

By using our Services, you agree to grant us a royalty-free, sub-licensable, perpetual license to use this data as set out in these terms. We may share this information with other third parties who assist us in providing the Service. In such circumstances, any data used will be anonymous and will not identify you as the source unless we receive your permission to do so.

Pro Accounts

Check Business Pro is a paid service where you receive uncapped access to the business information available online. Payments are collected monthly in advance and will continue until such time as you request to cancel your Pro account.

You may cancel your account at any time by sending an email requesting account cancellation to support@check-business.co.uk. When you request cancellation, no further monthly payments will be collected and you will continue to have access to all data and features which are part of the Basic (free) account.

Other terms

We reserve the right to vary these terms and conditions at any time, including assigning these terms. If we do so, we will notify you by email to the address provided when you signed up to the Service, or otherwise as updated by you through the Service.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain enforceable. Failure to exercise or enforce rights or provisions shall not constitute a waiver.

You agree that Check Business may send you notices via email, alerts within the service or postal mail.

Your use of the service is subject to the laws of England, and we both agree to submit to the jurisdiction of the English courts to settle any dispute that might arise.
